By completing the reservation and payment, you (The User) accept Akiba Kart (the Operator)’s Terms & Conditions below:

Akiba Kart Terms & Conditions

1.Compliance with the Terms & Conditions
The User agrees to comply with these Terms and Conditions when starting or continuing to use the Operator’s services. Furthermore, if the User does not agree to these terms, the User must not use these Services.

2.Compliance with the Traffic Laws
The User must obey Japanese traffic laws and other laws and regulations. The User must possess the driver’s license required for driving in Japan and have sufficient driving skills.

3.Confirmation of Vehicle Maintenance
The User must ensure that proper maintenance is performed when using this service. In particular, if the vehicle is improperly maintained resulting in an accident, the User is responsible for resolving the situation at their own risk.

4.Violation on Traffic Laws
The User acknowledges that they are fully responsible if they violate any Traffic Laws, etc., and will not make any inconvenience to the Operator. In the unlikely event that some penalty is incurred due to violation of Traffic Laws, etc., or if a tow truck is used, the User must immediately contact the Operator and commit to paying any related fines or fees.

5.Penalties Incurred Due to Violation of Traffic Laws, etc.
If the User violates Traffic Laws, etc., the Operator charges the User with the fine or penalty stipulated by the government and the User must pay the Operator immediately.

6.Traffic Accidents
If the User causes any traffic accident, he or she must immediately contact the Operator, the insurance company, and the police.

7.Prohibition on Settlement Related to Traffic Accidents
If the User causes a traffic accident that involves another person, he or she agrees not to make any settlement without the consent of the Operator. The User consents that they are solely responsible for any promises made without the consent of the Operator.

8.Rules Regarding Use of Optional Insurance
The User understands that they may use the optional automotive insurance to which the Operator belongs in the event of an accident. However, this shall not apply if the User is grossly negligent.

9.Copyright and Likeness Right
The User agrees to make no claim whatsoever to copyright and likeness rights related to photographs related to the usage of the vehicle, etc.

10.Vehicle Repair
If the User damages the Vehicle, etc., he or she commits to bearing the cost of repairing it. The User further understands that this shall not interfere with claims for damages by the Operator.

11.Prohibition of Use of Anti -Social Forces
The User agrees that he or she is not a member of anti-social forces such as a gang, nor of a company related thereto.

12.Prohibition of Use by Non-Applicants
The User must not permit anyone but the User who applied to use the Vehicle, etc., without the permission of the Operator.

13.Application for Commercial Purpose
If the User intends to use the Vehicle, etc. for commercial purposes such as transportation or advertising, they must apply for permission from the Operator.

14.Prohibition on Modifications and Returning in original Condition
Except for necessary maintenance, the User must not modify the Vehicle, etc., such as by attaching stickers or installing devices, etc., without the Operator’s consent. Furthermore, the Vehicle, etc. must be returned in its original condition.

15.Usage Time
The User is committed to returning the Vehicle, etc. at the place and time prescribed by the Operator. If the User exceeds this usage time, they must obtain the consent of the Operator and pay a late fee.

16.Claims for Damages and Penalties
If the User violates these Terms and Conditions and receives a claim for damages from the Operator, they are committed to paying this penalty immediately. In addition, if the User incurs some damage against the Operator, they must pay compensation for any such damages separately to the Operator.

17.Operator’s Disclaimer
The Operator assumes no responsibility whatsoever for any damages caused to the User in any case. The User acknowledges that the Operator may suspend, cancel, or change the Service as it sees fit.

18.Registration of privacy information and Consent of Use
The User agrees that the Operator will use privacy information including driver’s license and passport for the following reasons:

i) To check the identity and validity of use of this service under this agreement.
ii) To conduct a survey related with the Operator’s products and services and customer satisfaction.

19.Cancellation
Cancellation of the User’s booking must be in writing or by email to Akiba Kart Osaka. The User is entitled to 100% refund only if he/she gives the Operator 15 day notice of intention to cancel.

If the User chooses to cancel more than and equal to 2 days and fewer than and equal to 14 days before the start of the tour/rental, 75% refund will be granted.

If the User chooses to cancel equal to 1 days before the start of the tour/rental, 50% refund will be granted.

If the User chooses to cancel the same day of the start of the tour/rental, 0% refund will be granted.

With agreeing to the Terms and Conditions above, the User reserves and uses Akiba Kart
